1. Agreement to Terms

By accessing or using FitPerfect ("Platform," "Service"), you agree to be bound by these Terms of Service. These Terms apply to all users, including clothing retailers who subscribe to the platform ("Stores") and their end users ("Customers"). If you do not agree, do not use the Service.

2. Description of Service

FitPerfect provides an AI-powered virtual try-on platform for clothing retailers. Stores can list clothing items, and Customers can upload photos to generate virtual try-on images. The Service is provided on a subscription basis with plans ranging from Starter to Enterprise.

3. Account Registration & Store Responsibilities

Stores must provide accurate registration information including business name, address, and valid payment details.
Stores are responsible for all activity under their account, including how Customers use the try-on feature on their platform.
Stores must not share account credentials and must notify us immediately of any unauthorized access.
Stores are responsible for ensuring their use of FitPerfect complies with all applicable laws in their jurisdiction.

4. Subscriptions & Payment

All subscription plans are billed monthly. A 14-day free trial is available for new Stores. Billing begins automatically after the trial ends unless cancelled.

Payments are processed by Base44 Payments. By subscribing, you authorize recurring charges to your payment method. Prices are listed in USD and may be subject to applicable taxes based on your billing address.

Subscriptions auto-renew unless cancelled before the next billing date. No refunds are issued for partial billing periods. We reserve the right to change pricing with 30 days' notice.

5. Acceptable Use

You agree not to:

Upload photos of individuals without their explicit consent
Use the platform to generate inappropriate, illegal, or harmful content
Attempt to reverse-engineer, copy, or resell any part of the Service
Exceed plan limits through automated or fraudulent means
Use the Service for any purpose that violates applicable law

6. Intellectual Property

FitPerfect and its underlying technology, branding, and content are owned by us and protected by intellectual property law. Stores retain ownership of their clothing catalog content. AI-generated try-on images are provided for personal and commercial use within the platform. You may not reproduce or redistribute the FitPerfect platform itself.

7. AI-Generated Content Disclaimer

Virtual try-on images are generated by AI and are artistic approximations only. They are not guaranteed to accurately represent how a garment will look on any specific person. FitPerfect makes no warranty regarding the accuracy or fitness-for-purpose of AI-generated images. Customers should use try-on results as a general guide only.

8. Limitation of Liability

To the fullest extent permitted by law, FitPerfect shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business, arising from your use of the Service. Our total liability to any Store or Customer shall not exceed the amount paid by that Store in the 3 months preceding the claim.

9. Indemnification

Stores agree to indemnify and hold FitPerfect harmless from any claims, damages, or expenses arising from: (a) their use of the Service; (b) content they upload; (c) their Customers' use of try-on features; or (d) violation of these Terms.

10. Termination

We may suspend or terminate your account for violation of these Terms, non-payment, or any reason with reasonable notice. Stores may cancel at any time through their dashboard. Upon termination, your data is retained for 90 days then deleted, unless law requires otherwise.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

12. Changes to Terms

We may update these Terms at any time. Material changes will be communicated with 14 days' notice via email or in-platform notification. Continued use after the effective date constitutes acceptance.
